These Terms of Service ("Terms") govern your use of the website and services provided by SH People & Growth Pty Ltd ("SH Growth", "we", "us", "our"). By engaging our services or using our website, you agree to these Terms.
1. Services
SH Growth provides social recruiting campaign services, including the creation and management of paid advertising campaigns on social media platforms (Meta, LinkedIn, TikTok) for the purpose of attracting job candidates to our clients' roles.
Specific deliverables, timelines, and scope are agreed upon separately for each engagement.
2. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about the roles you wish to fill, your company, and your requirements.
- Review and approve campaign materials (ad copy, landing pages, application forms) in a timely manner before launch.
- Handle candidate data received through our campaigns in accordance with applicable privacy laws and employment legislation.
- Not use our services to advertise roles that are misleading, discriminatory, or unlawful.
3. Fees and Payment
Fees for our services are agreed upon prior to campaign commencement. Payment terms are specified in your service agreement. Late payments may incur additional charges.
Our fees cover campaign creation and management. Advertising spend (the budget paid directly to social platforms) is separate and handled according to the arrangement agreed with you.
4. Campaign Performance
While we apply best practice methods developed through experience across multiple markets, we do not guarantee specific outcomes such as a minimum number of applications, hires, or candidate quality. Campaign results depend on factors including role attractiveness, market conditions, location, and budget.
We will report on campaign performance and make optimisations throughout the campaign period.
5. Intellectual Property
Ad creative, copy, and campaign assets developed by SH Growth for your campaigns remain our intellectual property during the engagement. Upon completion and full payment, materials specifically created for your brand (landing pages, branded copy) may be used by you.
Our proprietary methodologies, frameworks, and processes remain the exclusive property of SH Growth at all times.
6. Candidate Data
Applications and candidate data collected through campaigns we run are delivered to you as the hiring party. You become the data controller for that information and are responsible for handling it in accordance with the Australian Privacy Act 1988 and any other applicable legislation.
7. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the engagement. This includes your company's hiring strategy, candidate details, and our campaign methodologies.
8. Limitation of Liability
To the maximum extent permitted by law, SH Growth's total liability to you for any claims arising out of or related to our services is limited to the fees paid by you in the three months preceding the claim.
We are not liable for indirect, incidental, consequential, or special damages, including loss of business, revenue, or data.
9. Termination
Either party may terminate the engagement by providing written notice as specified in the service agreement. Upon termination, you will be invoiced for work completed to that point. Fees paid for services not yet delivered will be refunded on a pro-rata basis, unless otherwise agreed.
10. Changes to Services
We reserve the right to update or modify our services. We will notify you of material changes that affect your current engagement.
11. Governing Law
These Terms are governed by the laws of South Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of South Australia.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms.
